Terms Of Service
Terms of Service and Warranty AgreementBy commissioning Softpaws Studio ("the Artist"), you agree to the following terms and conditions, including our warranty coverage for our fursuit creations:I. GENERAL TERMS1.1 Clear Reference: Please provide a clear reference sheet. Primary reference images MUST be unshaded and have at least 2 views, 3 is preferred. Do NOT send inaccurate reference sheets or images.1.2 Order Clarity: Be clear about your order specifications and requirements to ensure we meet your expectations.1.3 Behavior: Any ill behavior towards the Artist will not be tolerated, and commissions may be cancelled with no refund in such instances.1.4 Refurbishing: While you are allowed to refurbish suits as needed, original construction credit must be attributed to Softpaws Studio.1.5 Communication: Communication and commission transactions will be conducted through Telegram, Instagram, Twitter (X), or Discord.II. PAYMENT2.1 Currency: Payments must be made in USD through PayPal.2.2 Downpayment: A 50% downpayment is required before the commission work begins and is non-refundable.2.3 Payment Plans: Payment plans are available upon discussion and may incur a 25% additional fee. All clients doing a payment plan will be required to sign the Payment Plan Agreement with your legal name and agree to additional terms.2.4 Processing Fees: Softpaws Studio will not pay PayPal's processing fee. Any processing fees charged to the Artist must be covered by the client before the commission is delivered.2.5 Unsolicited Payments: Any unsolicited money sent will be considered a tip and will not be refunded.III. PROCESS3.1 Progress Updates: The Artist will provide work-in-progress photos during the commission process unless the client indicates otherwise.3.2 Completion Time: The completion time for digital art commissions may exceed 3 months, and fursuit commissions may exceed 1 year, depending on various factors such as complexity, material availability, health, work, school, or personal/family issues. Clients will be informed if any significant delays occur during the commission process.IV. CUSTOMER SATISFACTION4.1 Alterations: Softpaws Studio will strive to ensure customer satisfaction, but no alterations will be made after the commission is completed. Clients are advised to provide clear and detailed order instructions to ensure their expectations are met.V. COPYRIGHT / USAGE POLICY5.1 Copyright: The Artist holds the creation rights to the fursuit and its copyrighted artwork.5.2 Usage: The Artist is permitted to use copyrighted artwork for self-promotion, publications, display, and online sharing with proper credit to the owner of the character.5.3 Client Usage: The client is allowed to wear the fursuit publicly, resell it with the Artist's knowledge and informing the new owner of these Terms of Service for their continued use. Reselling the suit at a higher value than the original purchase price, without additional art or suit parts, is prohibited.5.4 Copyright Infringement: Any copyright infringement, such as commercial reproduction or taking credit for the artwork, will result in the forfeiture of all rights to the suit.VI. CANCELING/REFUNDING POLICY6.1 Cancellation: The Artist reserves the right to cancel and refund a commission at any time.6.2 Client Cancellation: Clients have no right to cancel or demand a refund once the commission has started, unless the commission has not yet begun.6.3 Chargeback: In the event of a chargeback filed by the client, the Artist retains the right to take appropriate actions, including public postings and filing complaints.6.4 Abandonment/Surrender: If the client does not respond or confirm updates from the Artist within a two-month period, the commission will be deemed abandoned. All materials, goods, and payments held by the Artist will be regarded as surrendered and will become the property of Softpaws Studio. The Artist reserves the right to repurpose any materials or goods as deemed appropriate.VII. SHIPPING7.1 Responsibility: Once the fursuit leaves Softpaws Studio, the Artist is no longer responsible for its care or condition.7.2 Costs: Shipping and duty costs are not included in the commission price and are the client's responsibility.VIII. WARRANTY1. Warranty CoverageOur fursuit warranty covers any defects in materials and workmanship that occur within 90 days from the date of receipt of your fursuit. This warranty is non-transferable and applies only to the original purchaser of the fursuit.2. Warranty Exclusionsa. Normal Wear and Tear: The warranty does not cover regular wear and tear resulting from normal use of the fursuit.b. Unauthorized Alterations: Any modifications or alterations made to the fursuit by anyone other than Softpaws Studio will void the warranty.c. Negligence or Misuse: Damage caused by neglect, misuse, or improper care of the fursuit is not covered under the warranty.d. Accidents or Acts of Nature: Damages resulting from accidents, mishandling, or exposure to extreme weather conditions are not covered.3. Warranty ClaimsTo initiate a warranty claim, please contact Softpaws Studio with a detailed description of the issue and photographic evidence of the defect. We will assess the claim and determine if it falls within the warranty coverage.4. Repair or ReplacementIf your warranty claim is approved, Softpaws Studio will, at our discretion, either repair or replace the defective components or parts of the fursuit. If a replacement is provided, it will be of equal or similar value to the original fursuit.5. Shipping CostsThe client is responsible for all shipping
Payment Plan AgreementThis Payment Plan Agreement ("Agreement") is entered into between [Client/Buyer's Name], hereinafter referred to as the "Client", and Softpaws Studio, hereinafter referred to as the "Provider," collectively known as the "Parties," on this [Date] ("Effective Date").1. Payment Plan Details:1.1 Payment Amount: The total amount of [Total Amount] shall be divided into equal installments of [Monthly/Biweekly/Weekly Installment Amount]. The payment plan shall commence on [Start Date] and conclude on [End Date].1.2 Payment Schedule: Payments shall be made on a [Monthly/Biweekly/Weekly] basis and shall be due on [Due Date].2. Missed Payment Penalty:2.1 Penalty: In the event that the Client misses a payment, a penalty of 25% of the missed amount shall be applied to the outstanding balance. This interest compounds.3. Cancellation Policy:3.1 Cancellation: If the Client fails to make a payment for three or more consecutive payments, the Provider reserves the right to cancel the payment plan without refunding any prior payments made by the Client.4. Payment Plan Pause:4.1 Pause Request: The Client may request a temporary pause of the payment plan for up to two months by providing the Provider with written notice at least one month in advance.4.2 During the paused period: No payments shall be required, and the payment plan will resume after the pause period. Only one pause period is permitted per payment plan.5. General Provisions:5.1 Entire Agreement: This Agreement constitutes the entire understanding between the Parties and supersedes any prior agreements, oral or written, with respect to the subject matter herein.5.2 Modification: Any modification to this Agreement must be made in writing and signed by both Parties.5.3 Governing Law: This Agreement shall be governed by and construed in accordance with the laws of Alberta, Canada, without regard to its conflict of law principles.6. Based on the information you provide and your desired specifications, we'll provide you with a personalized quote. We'll discuss payment options, including any potential payment plans to accommodate your needs.3. Securing Your Spot:
Upon agreement and receipt of any required deposit, your commission is added to our queue. This secures your spot and allows us to plan accordingly for your project.4. Material Selection and Ordering:
For fursuit commissions, we'll guide you in selecting the most suitable materials for your project. Once finalized, we'll order the materials, keeping you informed throughout the process.5. Work-in-Progress Updates:
As your commission moves up the queue, we'll begin crafting your creation with dedication and care. During this phase, we'll send you regular work-in-progress pictures, ensuring that you're part of the creative journey.6. Collaboration and Feedback:
Your input is invaluable to us. We encourage open communication during the creation process, allowing you to share your preferences, likes, and any changes you'd like to see. Please note that significant revisions may incur an additional cost, which we'll discuss with you beforehand.7. Final Touches and Quality Assurance:
With your feedback in mind, we'll apply the final touches to your commission, meticulously ensuring that every detail meets our high standards of quality and craftsmanship.8. Shipping and Warranty:
Once your creation is complete and has passed our rigorous quality checks, we'll hand it off for shipping. Please be aware that once the parcel is handed over, we are no longer responsible for it during transit.9. Arrival and Warranty Period:
Upon receiving your commission, the warranty period commences. We'll ensure that your satisfaction remains our top priority during this phase.Our commission process is designed to offer you a collaborative and delightful experience from concept to delivery.
